REQUESTED ACTION <br /> <br />1.1 Erik Corbett is requesting a minor variance to reduce the side yard setback of a <br />driveway to two feet for the purpose of bringing a recently replaced driveway into <br />compliance at 2706 Marion Street N. <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />5' Setback <br /> <br />2' Setback <br /> <br />3' Variance <br /> <br />2Jl BACKGROUND <br /> <br />2.1 Erik Corbett owns a home at 2706 Marion Street N. The property is zoned R-1 <br />Single Family Residential and adjacent land uses are all single family residential. <br /> <br />2.2 Mr. Corbett is requesting a variance from Section 703.048, City Code, to allow the <br />continuance of a driveway less than five feet from the side property line. The owner <br />replaced the existing driveway on this property earlier this summer; however, he <br />was not aware that a building permit was required for concrete work. The new <br />concrete driveway was placed in the same location as the existing concrete and <br />asphalt driveway on the property. When Mr. Corbett became aware of the City's <br />building permit requirements and applied for a building permit for the driveway, he <br />was informed that the driveway was non-conforming and he would need a variance. <br /> <br />2.3 It is also the policy of the City of Roseville to issue minor variances for driveway side <br />yard setbacks when nonconforming driveways are replaced, provided the property <br />is located in an R-1, Single Family Residential District, and used for residential <br />purposes. <br /> <br />2.4 Section 703.048, City Code, states, "residential driveways shall be constructed so <br />that the edge of the driveway nearest to the side lot line shall be a minimum of five <br />feet from the side lot line." <br /> <br />P#2942 - RCA - Page 1 of 2 <br />
