<br />REQUESTFORCOUNC~AcnON <br /> <br />DATE: 09/22/97 <br />ITEM NO: 1-3 <br /> <br />Manager Approved: Agenda Section: <br />~t9- LAND USE <br /> <br />ACR Homes, Inc., request for a conditional use permit to allow the <br />conversion of existing space and the operation of a take-outlself- <br />service restaurant at 2215 Snelling Avenue N (PF#2945). <br /> <br /> <br />1Jl REQUESTED ACTION <br /> <br />1.1 ACR Homes, Inc. is requesting a conditional use permit to allow the conversion of <br />existing space to allow the operation of a take-outlself-service restaurant <br />(Blimpie's) in a portion of the building located at 2215 Snelling Avenue N. <br /> <br />1.2 The conditional use permit process allows the City to consider compatibility with <br />adjoining properties; impacts on traffic, public facilities, and property values; impact <br />on the general health, safety, and public welfare; and compatibility with the City's <br />comprehensive plan. The process also allows the City to impose those conditions <br />it considers necessary to protect the public health, safety, and welfare. <br /> <br />2JJ. BACKGROUND <br /> <br />2.1 ACR Homes, Inc. holds a purchase agreement for the property at 2215 Snelling <br />Avenue N, which is owned by Marco Property Management (Irving Margolis and <br />Teddy Wong). The .56 acre parcel is located in a B3, General Business District, <br />and the Comprehensive Plan designates the property as Business. Adjacent land <br />uses include high density residential to the north and northwest, and commercial to <br />the east, south, and west. <br /> <br />/ <br /> <br />2.2 The site is occupied by a 4,050 square foot building. This building was previously <br />used as a medical office building; however, it has been vacant for several years. <br />The site development plan submitted by the applicant shows 3,410 square feet of <br />the building remaining as office area for ACR Homes, Inc., and the conversion of <br />640 square feet for a Blimpie's restaurant with 40 seats. <br /> <br />2.3 When the restaurant in Rosewood Center, the multi-tenant retail center to the south, <br />was converted to an Outback Steakhouse earlier this year, an analysis of parking <br />at this facility was undertaken. Based on the findings of this analysis, the City <br />required a cross parking and access easement between this property and the <br />property at 2215 Snelling Avenue, which are both owned by Marco Property <br />Management, in order to meet the required off-street parking requirements. A <br />minimum of 45 off-street parking spaces was to be provided on the 2215 Snelling <br /> <br />RCA (PF2945) - 09/22/97 - Page 1 of 4 <br />
