Mesm. Margolis and Wong axe also partners on the <br />adjoining shopping center and have signed but apparently never recorded an easement <br />agreement granting reciprocal, perpetual easements across the respective parcels for tbe <br />purpose of parking and ingress/egress_ It is our understanding this was done so as to provide <br />additional parking when the Outback Steakhouse opened for business in the shopping <br />center. We understand Outback has a ten year lease with 4 options to renew the lease or <br />extend the term. for periods of five years each. <br /> <br />I was asked to send you this letter descn'bing the proposed change in this easement <br />agreement, with tbe expectation that the city win indicate it j~ agree~ble to this change. <br /> <br />In essence what is being proposed is that the easement wiJI be amended to provide <br />that it will last for a period of ten years (commencing on tbe date of the original easement <br />agreement), with a provision that either party can cancel the Agreement effec.tive at any <br />time after the tenth annivenB.Iy of tbe date of the original agreement) by giving written <br />notice to the other party (and filing such notice) at least one year in advance. of the date of <br />termination as specified in the notice.
