Nelson and Dorothy M. Nelson, hU5band and wife (coIJectively IINeIson"). <br /> <br />RECITALS: <br /> <br />Rosewood is the owner of the real property located in the City of Roseville, County <br />of Ramsey, State of Minnesota. legally described on attached Exhibit A (the ''Rosewood <br />~~~ . <br /> <br />Nelson is the owner of the real property located in. the City of Roseville, County of <br />Ramsey, State of Minnesota legally described on. attached Exhibit B (the "NeJson Property'). <br /> <br />The Rosewood Property is appurtenant to the Nelson Property. <br /> <br />By Easement Agreement dated Apri128, 1997 (the "Original Agreement"), which has <br />not been recorded, Rosewood and Nelson's predecessor in interest as owner of the Nelson <br />Property, created certain easements and covenants. <br /> <br />The parties desire to restate the Original Agreeme:n.t in it5 entirety by tbjs Restated <br />Easement Agreement. <br /> <br />THEREFORE, in consideration of the mutual covenants of the partjes and other <br />valuabl~ consideration, the receipt and sufficiency of which are hereby acknowJedged, the <br />parties agree as follows: <br /> <br />AGREEMENT: <br /> <br />1. MutuaLGrant of Easement. Rosewood hereby grants to Nebon and to the <br />su~essors and assigns of Ne]son? as an easement appurtena.nt to the Nelson Propeny, and <br />Nelson hereby grants to Rosewood a.nd to the successors and assigns of Rosewood, as an <br />easement appurtenant to the Rosewood Property, a non-exclusive easement on, over, upon <br />and across the Easement Premises (as hereinafter defined) for the following pmposes: <br /> <br />A For vehicle access from the dedicated public roads adjacent to the Rosewood <br />Property and the Nelson Property through the driveways and roadways from <br />time to time existing upon the Rosewood Property and the N~lson Property <br />to the parking areas from time to time e~ting upon the. Rosewood Property <br />and the Nelson Property. Such driveways and roadways may, from time to <br />time, be constructed, razed, reconstructed, and relocated so long as reasonable <br />access to such parking areas remaim followh'8 any such actions. <br /> <br />795664.3 <br />
