<br />.' <br /> <br />4Jl STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outlined in Section 3.1 of this report, staff recommended <br />approval of the request for a conditional use permit to allow the conversion of <br />existing space to allow the operation of a take-outlself-service restaurant <br />(Blimpie's) in a portion of the building located at 2215 Snelling Avenue, with the <br />following conditions: <br /> <br />1. A minimum of 45 off-street parking spaces must be provided on-site to <br />remain in compliance with the access and parking easement between <br />Rosewood Center property and the ACR Homes, Inc. property, which was <br />required by the City. This number will also provide and to provide adequate <br />off-street parking for the proposed uses in the ACR Homes, Inc. building. <br />The configuration of the off-street parking may be modified, provided it <br />continues to comply with this condition and the off-street parking standards <br />outlined in the City Code. <br /> <br />2. A two-way traffic lane must be provided between the northern wall of the <br />Rosewood Center building and the ACR Homes, Inc. building. This will <br />provide access to the rear side (west) of the ACR Homes, Inc. building <br />without creating conflict with the required one-way fire lane around the west <br />and north sides of the Rosewood Center building. <br /> <br />3. Any and all signage must comply with the provisions of Chapter 1009 of the <br />City Code. <br /> <br />4. Any exterior trash area must be completely enclosed and constructed of the <br />same materials as the principal structure. <br /> <br />5. The applicant must work with City staff on site development issues to ensure <br />that any exterior improvements comply with Chapter 1010 of the City Code. <br /> <br />Ul PLANNING COMMISSION ACTION <br /> <br />5.1 On September 10, 1997, the Planning Commission held a public hearing on the <br />request. Jim Nelson, ACR Homes, Inc., was present to answer questions and <br />provide additional information. Three residents spoke in opposition to the request. <br /> <br />5.2 The Planning Commission discussed the change in use, proposed improvements, <br />proposed signage, conformance with the City's design standard requirements, and <br />the lack of an acceptable site development plan. <br /> <br />5.3 The Planning Commission tabled action on the request and asked that the following <br />information be provided for review at the October 8, 1997, meeting: clarification of <br />oft-street parking layout, placement of trash enclosure, drawings showing proposed <br />signage (all four views), feasibility of curb and gutter, the traffic study from the past <br /> <br />RCA (PF2945) - 09/22/97 - Page 3 of 4 <br />
