<br />Agreement on Alternate Surface Water Ponding Design <br />August 14, 1997 <br /> <br />This agreement between Fairview H.A. and the City of Roseville is set forth to define the <br />purpose and responsibilities of the two parties regarding an on-site surface water ponding area <br />within property owned by John Allen at 2555 Fairview Avenue, Roseville, Minnesota. The <br />concerns include placement on the site, size, capacity, design, construction techniques, fencing, <br />future renovation/redesign, and indemnity. <br /> <br />L Background <br />1.1 It is understood that Rice Creek Watershed has issued necessary permits to John Allen for <br />the development located at 2555 Fairview Avenue to store water derived from surface run off on <br />the site in conformance with the Rice Creek Watershed requirements. <br /> <br />1.2 The City of Roseville also has certain additional policies used to guide the safe and <br />efficient use of storm water ponding area. A portion of those policies require ponds to be <br />constructed to a 3H: I V slope within the first _ feet of the pond. The purpose of this slope is to <br />provide a gentle slope to preclude intruders from being immediately immersed in deep water. <br /> <br />1.3 The City of Roseville has adopted a policy as part of the Tower Place Master Plan which <br />states that if possible, small on-site ponding areas are less efficient and less desirable than <br />subregional and regional ponding areas that handle storm run-off from multiple sites. The Allen <br />property is located within the Tower Place Master Plan area. <br /> <br />1.4 In 1997, the City of Roseville placed a temporary moratorium on new surface water <br />contributions to the regional pond serving the Allen site (James Addition Pond). Because of this <br />temporary moratorium, the Allen development was required to construct an alternative ponding <br />site on the Allen property to store all surface water run off created by the impervious surfaces on <br />the Allen property. <br /> <br />I <br />
