<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 09/22/97 <br />ITEM NO: c- 5 <br /> <br /> <br />Mana er Approved: Agenda Section: <br />~ CONSENT <br /> <br />Ryan Companies US, Inc., request for vacation of a 20 foot drainage <br />and utility easement dedicated on the plat of Centre Pointe Business <br />Park (PF#2947). <br /> <br /> <br />~ REQUESTEDACnON <br /> <br />1.1 Ryan Companies US, Inc. is requesting the vacation of a 20 foot drainage and utility <br />easement dedicated on the plat of Centre Pointe Business Park. The drainage and <br />utility easement is adjacent to the common boundary of Lots 1 and 2, Block 3, <br />Centre Pointe Business Park, and extends northeasterly across Lot 1 to its <br />intersection with the east line of Lot 1. <br /> <br />2.J1 BACKGROUND <br /> <br />2.1 Ryan Companies US, Inc. owns Lots 1 and 2, Block 3, Centre Pointe Business <br />Park. The property is currently vacant, is designated as Business in the City's <br />Comprehensive Plan, and is located in a PUD, Planned Unit Development District. <br /> <br />2.2 In order to facilitate the development of the Centre Pointe Business Park, a portion <br />of Lot 1, Block 3, has been combined with Lot 2, Block 3. This combination was <br />allowed under the provisions of the Planned Unit Development Agreement for this <br />project and was approved by the Director of Community Development in <br />accordance with Section 11 04.04C of the City Code. <br /> <br />2.3 It is the intent of the owner to develop the property as two multi-tenant buildings, <br />which have a gross floor area of 102,000 square feet. With the combination of the <br />two parcels, the existing utility and drainage easement and sanitary sewer line <br />which was located along a lot line is now located through the middle of the parcel. <br />Since a building cannot be constructed over a utility easement or sanitary sewer <br />pipe, Ryan Companies has petitioned the City to vacate the existing easement and <br />accept a new easement. The vacation of the existing 20 foot utility and drainage <br />easement and the acceptance of a new 20 foot utility and drainage easement will <br />allow the property to be developed as proposed. <br /> <br />2.3 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. <br /> <br />RCA (PF2944) - 09/22/97 - Page 1 of 3 <br />
