<br />3Jl STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff has made the following findings: <br /> <br />1. A 20 foot utility and drainage easement over, under, and across Lots 1 and <br />2, Block 3, was dedicated on the plat of Centre Pointe Business Park. <br /> <br />2. The combination of a portion of Lot 1, Block 3, with Lot 2, Block 3, resulted <br />in the utility and drainage easement being located in the middle of a <br />buildable parcel. <br /> <br />3. This utility and drainage easement contains a sanitary sewer line. <br /> <br />4. In order to develop this parcel as proposed, the existing utility easement will <br />need to be vacated, a new easement will need to be accepted, and the <br />existing sanitary sewer line will need to be moved to the new easement. The <br />City has executed the document to accept the new easement and a permit <br />to relocate the sanitary sewer line will be issued upon recording of the new <br />easement. <br /> <br />5. The proposed vacation of the existing utility and drainage easement and the <br />acceptance of a new utility and drainage easement will not have an adverse <br />impact on the general public health, safety and welfare. <br /> <br />6. The proposed vacation of the existing utility and drainage easement and the <br />acceptance of a new utility and drainage easement will facilitate the <br />development of Centre Pointe Business Park as approved by the City <br />Council. <br /> <br />4Jl STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends <br />approval of the request for vacation of a 20 foot drainage and utility easement <br />dedicated on the plat of Centre Pointe Business Park. <br /> <br />M PLANNING COMMISSION ACTION <br /> <br />5.1 On September 10, 1997, the Planning Commission held a public hearing on the <br />request. Kent Carlson, Ryan Companies, was present to answer questions and <br />provide additional information. No residents present commented on this request. <br /> <br />5.2 The Planning Commission recommended approval of the request for vacation of <br />a 20 foot drainage and utility easement dedicated on the plat of Centre Pointe <br />Business Park, based on the findings outlined in Section 3.1 of this report <br /> <br />RCA (PF2944) - 09/22/97 - Page 2 of 3 <br />
