<br />RELEASE OF DRAINAGE AND UTILITY EASEMENT <br />05-14-18 <br /> <br />THIS RELEASE, made and entered into this __ day of , 1998, given <br />by the City of Roseville, a Minnesota municipal corporation, (hereinafter called "City"). <br /> <br />WITNESSETH THAT: <br /> <br />WHEREAS, by Drainage and Utility Easement, dated September 9, 1997, and filed <br />November 17, 1997, as Document No. 3024117 in the office of the County Recorder, Ramsey <br />County, Minnesota, (the "Easement"), City was granted a perpetual, non-exclusive easement for <br />drainage and utility purposes under, over and across the following described property (the <br />"Subject Property"): <br /> <br />A 20 foot wide Drainage and Utility Easement over, under and across that part of Lots I <br />and 2, Block 3, CENTRE POINTE BUSINESS PARK, according to the recorded plat <br />thereof; Ramsey County, Minnesota, the centerline described as follows: <br /> <br />Commencing at the northeast comer of said Lot I; thence South 00 degrees 00 <br />minutes 00 seconds East, assumed bearing, along the east line of said Lot I, a <br />distance of 348.53 feet to the beginning of the centerline to be described; thence <br />South 46 degrees 46 minutes 22 seconds West, a distance of 133.23 feet; thence <br />North 45 degrees 26 minutes 27 seconds West. a distance of 147.08 feet; thence <br />South 44 degrees 33 minutes 33 seconds West, a distance of 144.01 feet; thence <br />South 89 degrees 02 minutes 20 seconds East, a distance of 76.41 feet to the west <br />line of said Lot 2 and siad centerline there terminating. <br /> <br />The sidleines of said easement are to be prolonged or shortened to terminate at <br />said East line of Lot I and said west line of Lot 2. <br /> <br />WHEREAS, the City was granted a replacement perpetual non-exclusive public easement <br />for drainage and utility purposes by Ryan Companies US, Inc. by that certain Easement of even <br />date herewith. <br /> <br />WHEREAS, the easements granted in the Easement are no longer needed by the City, and <br />the City desires to release the Subject Property from the Easements contained therein. <br /> <br />NOW, THEREFORE, In and for valuable consideration, receipt whereof is hereby <br />acknowledged, City hereby grants, conveys, releases and discharges, without warranty all of its <br />right, title and interest in and to the Subject Property as acquired by the Easement. <br /> <br />) ILEGIJAH\FORMSlEASREL DOC I1<K <br />
