<br />REQUESTFORCOUNC~AcnON <br /> <br />DATE: 09/08/97 <br />ITEM NO: c- 2 <br />ent Approval: M Agenda Section: <br />CONSENT <br />Item Description: David Rychlicki request for a minor variance for a detached garage at <br />2754 Huron Street N (PF#2951). <br /> <br />1J1 REQUESTED ACTION <br /> <br /> <br /> <br />1.1 David Rychlicki is requesting a minor variance to replace an existing accessory <br />building (detached garage) within the side yard of a parcel and to reduce the front <br />yard setback to 24 feet at 2754 Huron Street N. <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />Accessory building <br />must be in rear yard <br /> <br />Placement of <br />accessory building <br />in side yard <br /> <br />(Comer lot with <br />only one side <br />lot line) <br /> <br />Front yard setback - 30' <br />(A corner lot has two 30' setbacks) <br /> <br />24' setback <br /> <br />6' <br /> <br />Ul BACKGROUND <br /> <br />2.1 David Rychlicki owns a home at 2754 Huron Street N. The property is zoned R-1 <br />Single Family Residential and adjacent land uses are all single family residential. <br /> <br />2.2 Mr. Rychlicki is requesting a variance from Section 1 004.01A to allow the placement <br />of an accessory building in a location other than the rear yard. The existing 20' x <br />20' detached garage is located in the side yard on the east side of the parcel and <br />is approximately 15 feet from the right-of-way line of Judith Avenue W. Mr. <br />Rychlicki would like to remove this structure, which is need of replacement, and <br />construct a new detached garage in the same general location. The proposed 26' <br />x 34' detached garage would be located approximately 24 feet from the right-of-way <br />line of Judith Avenue W, which is in line with the detached garage on the property <br />directly to the east. Locating the detached garage in this location will also preserve <br />two trees in the rear yard of Mr. Rychlicki's parcel and protect the view of the <br />neighbor to the east. The new garage will not be located any closer to the east lot <br />line than the existing garage. The location of mature trees on the parcel creates <br />a practical difficulty for the applicant. <br /> <br />2.3 Section 1004.01A, City Code, states, "no accessory building shall be erected or <br />located within any yard other than the rear yard except for a through lot when it shall <br />be located in the side yard." <br /> <br />PF#2951 - RCA (09/08/97) - Page 1 of 2 <br />
