<br />Section 1004.02D requires a minimum front yard setback of 30 feet. <br /> <br />JJ1. MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed garage, written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Rebecca <br />Sorlien and Ronald LaStand at 2755 Dellwood Street N). <br /> <br />3.2 The Minor Variance Committee reviewed this request on August 19, 1997, and <br />unanimously recommended approval of a minor variance to allow the placement of <br />a detached garage in the side yard and to reduce the front yard setback to 24 feet <br />at 2754 Huron Street N, based on the following findings: <br /> <br />1. The existing garage on the property is in need of replacement. <br /> <br />2. The new garage will be constructed in the same general location as the <br />existing garage; however, it will be moved further back an additional nine feet <br />from the right-of-way line of Judith Avenue W. <br /> <br />3. The front of the new garage will be in line with the front of the garage on the <br />property directly adjacent to and east of this property. <br /> <br />4. The location of two mature trees in the rear yard creates a practical difficulty <br />for placing the garage in the rear yard. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />~ SUGGESTEDACnON <br /> <br />4.1 By motion, approve David Rychlicki's request for a minor variance to replace an <br />existing accessory building (detached garage) within the side yard of a parcel and <br />to reduce the front yard setback to 24 feet at 2754 Huron Street, based on the <br />findings of the Minor Variance Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property (current layout); sketch of property (proposed <br />layout); photographs of property. <br /> <br />60-day Time Limit: Application accepted on August 15, 1997; Decision deadline is October 14, 1997. <br /> <br />Prepared by: Kim L.
