Section 1004.02D requires a minimum front yard setback of 30 feet.

JJ1. MINOR VARIANCE COMMITTEE

3.1 The request for the variance included the required application form, sketch of the
property and proposed garage, written statement from the applicant, and written
approval from the adjacent property owners affected by the variance (Rebecca
Sorlien and Ronald LaStand at 2755 Dellwood Street N).

3.2 The Minor Variance Committee reviewed this request on August 19, 1997, and
unanimously recommended approval of a minor variance to allow the placement of
a detached garage in the side yard and to reduce the front yard setback to 24 feet
at 2754 Huron Street N, based on the following findings:

1. The existing garage on the property is in need of replacement.

2. The new garage will be constructed in the same general location as the
existing garage; however, it will be moved further back an additional nine feet
from the right-of-way line of Judith Avenue W.

3. The front of the new garage will be in line with the front of the garage on the
property directly adjacent to and east of this property.

4. The location of two mature trees in the rear yard creates a practical difficulty
for placing the garage in the rear yard.

5. The proposed variance is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).

6. The variance, if granted, will not adversely affect the public health, safety, or
general welfare.

~ SUGGESTEDACnON

4.1 By motion, approve David Rychlicki's request for a minor variance to replace an
existing accessory building (detached garage) within the side yard of a parcel and
to reduce the front yard setback to 24 feet at 2754 Huron Street, based on the
findings of the Minor Variance Committee outlined in section 3.2 of this report.

Attachments: Property location map; minor variance application; written statement from applicant; written
consent from adjacent property owners; sketch of property (current layout); sketch of property (proposed
layout); photographs of property.

60-day Time Limit: Application accepted on August 15, 1997; Decision deadline is October 14, 1997.

Prepared by: Kim L.
