REQUESTED ACTION <br /> <br />1.1 Thomas and Mary Lou Nicholls are requesting a minor variance to reduce the side <br />yard setback of a driveway to less than one foot for the purpose of replacing an <br />existing driveway at 2160 Draper Avenue W. <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />5' Setback <br /> <br />< l' Setback <br /> <br />5' Variance <br /> <br />2J1 BACKGROUND <br /> <br />2.1 Thomas and Mary Lou Nicholls own a home at 2160 Draper Avenue W. The <br />property is zoned R-1 Single Family Residential and adjacent land uses are all <br />single family residential. <br /> <br />2.2 Mr. and Mrs. Nicholls are requesting a variance from Section 703.048, City Code, <br />to allow the replacement and continuance of a driveway less than five feet from the <br />side property line. The owners would like to replace the driveway on the property, <br />which has been in this location since the property was platted in 1969. The garage <br />was originally accessed from Roselawn; however, when the property was platted <br />in 1969 and Westwood Circle was created, the access to the garage had to be <br />moved to Draper Avenue. In order to get around the home and into the garage door <br />on the south side of the house, the driveway has to remain less than five feet from <br />the west property line. <br /> <br />2.3 It is the policy of the City of Roseville to issue minor variances for driveway side <br />yard setbacks when nonconforming driveways are replaced, provided the property <br />is located in an R-1, Single Family Residential District, and used for residential <br />purposes. <br /> <br />2.4 Section 703.048, City Code, states, "residential driveways shall be constructed so <br />that the edge of the driveway nearest to the side lot line shall be a minimum of five <br />feet from the side lot line." <br /> <br />PF#2952 - RCA (08/25/97) - Page 1 of 2 <br />
