JJl MINOR VARIANCE COMMITTEE

3.1 The request for the variance included the required application form, sketch of the
property and driveway, written statement from the applicant, and written approval
from the adjacent property owner affected by the variance (Thomas and Kay Barrett
at 2170 Draper Avenue W).

3.2 The Minor Variance Committee reviewed this request on August 19, 1997, and
unanimously recommended approval of a minor variance to allow the replacement
and continuance of a driveway less than one foot from the west side property line
at 2160 Draper Avenue W, based on the following findings:

1. The existing setback from the west property line will not be reduced.

2. The width of the driveway will not exceed 26 feet at the property line.

3. The proposed variance is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).

4. The variance, if granted, will not adversely affect the public health, safety, or
general welfare.

~ SUGGESTEDACnON

4.1 By motion, approve Thomas and Mary Lou Nicholls' request for a minor variance
to reduce the driveway setback to less than one foot along the west side property
line for the purpose of replacing an existing driveway at 2160 Draper Avenue W,
based on the findings of the Minor Variance Committee outlined in section 3.2 of
this report.

Attachments: Property location map; minor variance application; written statement from applicant; written
consent from adjacent property owners; sketch of property; photographs of property.

60-day Time Limit: Application accepted on August 15, 1997; Decision deadline is October 14, 1997.

Prepared by: Kim L.
