JJl MINOR VARIANCE COMMITTEE

3.1 The request for the variance included the required application form, sketch of the
property and proposed driveway, written statement from the applicant, and written
approval from the adjacent property owners affected by the variance (Jerry
Rahmeyer at 1869 Victoria Street N).

3.2 The Minor Variance Committee reviewed this request on September 3,1997, and
unanimously recommended approval of a minor variance to reduce the side yard
setback of a driveway to less than one foot for the purpose of constructing a new
driveway at 1861 Victoria Street North, based on the following findings:

1. The location of the house, the location of the existing driveway, the presence
of mature trees on the south side of the parcel, and the change in
topography on the south side of the parcel creates a practical difficulty for the
applicant.

2. The width of the driveway will not exceed 26 feet at the property line.

3. The proposed variance is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).

4. The variance, if granted, will not adversely affect the public health, safety, or
general welfare.

~ SUGGESTEDACnON

4.1 By motion, approve Delton Schirmer's request for a minor variance to reduce the
side yard setback of a driveway to less than one foot for the purpose of constructing
a new driveway at 1861 Victoria Street North, based on the findings of the Minor
Variance Committee outlined in section 3.2 of this report.

Attachments: Property location map; minor variance application; written statement from applicant; written
consent from adjacent property owners; sketch of property; photographs of property.

60-day Time Limit: Application accepted on August 20, 1997; Decision deadline is October 19, 1997.

Prepared by: Kim L.
