<br />2.3 It is the intent of the applicant to demolish the play area and create open space for <br />the multi-family residential use. Additional four-plexes may be constructed in the <br />future, although the timing and location of such construction has not yet been <br />determined. <br /> <br />2.4 The proposed reconstruction of the McDonald's restaurant will require a conditional <br />use permit, which will include a separate public hearing before the Planning <br />Commission. <br /> <br />2.5 Section 1015 of the City Code outlines the procedure for amending the zoning code <br />and the official zoning map. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff has made the following findings: <br /> <br />1. The City's Comprehensive Plan map designates the entire parcel located at <br />2075 Snelling Avenue North as Business and the entire parcel located at <br />2096 Fry Street North as High Density Residential. <br /> <br />2. The City's Comprehensive Plan text does not specifically address this parcel; <br />however, it is the policy of the City to discourage the encroachment of <br />commercial uses into residential neighborhoods. The transfer of the west .54 <br />acres of the McDonald's parcel to the adjacent multi-family parcel, along with <br />the designation of the .54 acres as high density residential and the rezoning <br />of the parcel to R3A, will remove the commercial encroachment into a <br />residential area. <br /> <br />3. A minor subdivision to transfer this property from 2075 Snelling Avenue <br />North (McDonald's - land owned by applicant) to 2096 Fry Street North (four- <br />plexes - land owned by applicant) was approved by the City Council on <br />September 8, 1997, subject to approval of a comprehensive plan <br />amendment and rezoning of the parcel. <br /> <br />4. A request for a comprehensive plan amendment to change the designation <br />of this parcel from Business to High Density Residential was recommended <br />for approval by the Planning Commission on December 10, 1997, and is <br />scheduled for City Council action on January 12, 1998. <br /> <br />5. The proposed rezoning is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The proposed rezoning will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />PF#2958 - RPCA (01/14/98) - Page 2 of 3 <br />
