2. The City's Comprehensive Plan text does not specifically address this parcel;
however, it is the policy of the City to discourage the encroachment of
commercial uses into residential neighborhoods. The transfer of the west .54
acres of the parcel to the adjacent parcel, along with the designation of the
.54 acres as high density residential and the rezoning of the parcel to R3A,
will remove the commercial encroachment into a residential area.

3. A minor subdivision to transfer this property from 2075 Snelling Avenue
North (McDonald's - land owned by applicant) to 2096 Fry Street North (four-
plexes - land owned by applicant) was approved by the City Council on
September 8, 1997, subject to approval of a comprehensive plan
amendment and rezoning of the parcel.

4. The proposed comprehensive plan amendment is in harmony with the
general purpose and intent of the City's Comprehensive Plan and Title 10 of
the City Code (Zoning).

5. The proposed comprehensive plan amendment will not adversely affect the
public health, safety, or general welfare.

~ STAFF RECOMMENDATION

4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends
approval of the request for a comprehensive plan amendment to change the
designation of the west .54 acre of the parcel located at 2075 Snelling Avenue
North from Business to High Density Residential, and re-affirmation of the minor
subdivision with the following provisions:

1. A 20 foot wide private utility easement for water service must be dedicated
in the appropriate location within the.54 acre parcel being transferred.

2. A 20 foot wide access easement for public safety protection must be
dedicated through the McDonald's parking lot in a location approved by the
City.

~ PLANNWGCOMM~~ONACnON

5.1 On December 10, 1997, the Planning Commission held a public hearing on the
request. Steve Halverson (NIPS, Inc.) and Craig Barnes (McDonald's) were present
to answer questions and provide additional information. No residents present
commented on this request.

5.2 The Planning Commission discussed the future use of the .54 acres (comparable
to existing four-plexes, although no plans have been finalized) and the apparent use
of the off-street parking area of the apartments for vehicle storage.

RCA (PF#2958) - 01/12/98 - Page 3 of 4
