<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 09/22/97 <br />ITEM NO: c- 2 <br /> <br /> <br />Mana r Approved: Agenda Section: <br />~ CONSENT <br />Louis Stacey request for a minor variance for a driveway at 518 <br />Heinel Drive (PF#2960). <br /> <br /> <br />~ REQUESTEDACnON <br /> <br />1.1 Louis Stacey is requesting a minor variance to reduce the side yard setback of a <br />driveway to three feet for the purpose of constructing an addition to an existing <br />driveway at 518 Heinel Drive. <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />Driveway Setback - 5' <br /> <br />3' setback <br /> <br />2' variance <br /> <br />2Jl BACKGROUND <br /> <br />2.1 Louis Stacey owns a home at 518 Heinel Drive. The property is zoned R-1 Single <br />Family Residential and adjacent land uses are all single family residential. <br /> <br />2.2 Mr. Schirmer is requesting a variance from Section 703.048, City Code, to allow the <br />placement of a driveway less than five feet from the side property line. The <br />applicant has applied for a building permit for replacing the existing driveway and <br />adding a parking stall adjacent to the existing driveway. Since the proposed parking <br />stall is less than five feet from the property line, a variance is needed prior to <br />proceeding with the project. A 3.5' high retaining wall is located along this side of <br />the property in a location three feet from the property line. Rather than constructing <br />the driveway addition two feet from the retaining wall and trying to maintain a two <br />foot strip of vegetation, the applicant would like to pave up to the retaining wall. The <br />location of the retaining wall in relationship to the existing driveway creates <br />a practical difficulty for the applicant. <br /> <br />2.3 It is the policy of the City of Roseville to issue minor variances for driveway side <br />yard setbacks when there is a hardship or practical difficulty, provided the property <br />is located in an R-1, Single Family Residential District, and used for residential <br />purposes. <br /> <br />2.4 Section 703.048, City Code, states, "residential driveways shall be constructed so <br />that the edge of the driveway nearest to the side lot line shall be a minimum of five <br />feet from the side lot line." <br /> <br />PF#2960 - RCA (09/22/97) - Page 1 of 2 <br />
