<br />~ MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed driveway, written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Thomas <br />Prokoach at 522 Heinel Drive). <br /> <br />3.2 The Minor Variance Committee reviewed this request on September 17, 1997, and <br />unanimously recommended approval of a minor variance to reduce the side yard <br />setback of a driveway to three feet for the purpose of constructing an addition to an <br />existing driveway at 518 Heinel Drive, based on the following findings: <br /> <br />1. The location of the retaining wall in relationship to the existing driveway <br />creates a practical difficulty for the applicant. <br /> <br />2. The width of the driveway will not exceed 26 feet at the property line. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />4. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4Jl SUGGESTED ACTION <br /> <br />4.1 By motion, approve Louis Stacey's request for a minor variance to reduce the side <br />yard setback of a driveway to three feet for the purpose of constructing an addition <br />to an existing driveway at 518 Heinel Drive, based on the findings of the Minor <br />Variance Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property; photographs of property. <br /> <br />60-day Time Limit: Application accepted on September 8, 1997; Decision deadline is November 7, 1997. <br /> <br />Prepared by: Kim L.
