<br />2.4 Section 1 012.02(B)(2), City Code, allows a maximum fence height of four feet within <br />the front yard setback area. <br /> <br />J..O. MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, a sketch of the <br />property and proposed fence, a written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Daniel <br />Hathaway at 2645 Galtier Street and Wallace Bell at 2654 Matilda Street). <br /> <br />3.2 The Minor Variance Committee reviewed this request on November 4, 1997, and <br />unanimously recommended approval of a minor variance to increase the height of <br />a fence within the front yard setback area of County Road C to 6.5 feet at 2646 <br />Matilda Street, based on the following findings: <br /> <br />1. The location of the property across County Road C from the off-street <br />parking and basketball facilities at Acorn Park adversely impacts the privacy <br />of the applicant. <br /> <br />2. The location of the property on a corner limits the rear yard area of the parcel <br />and creates a practical difficulty for the applicant. <br /> <br />3. The proposed 6.5 foot fence will not impact site lines at the intersection of <br />Matilda Street and County Road C. <br /> <br />4. None of the adjacent residences face toward County Road C; therefore, the <br />fence will not impact front yard views. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />~ SUGGESTEDACnON <br /> <br />4.1 By motion, approve Greg Schroder's request for a minor variance to increase the <br />height of a fence within the front yard setback area of County Road C to 6.5 feet at <br />2646 Matilda Street, based on the findings of the Minor Variance Committee <br />outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property; photographs of property. <br /> <br />60-day Time Limit: Application accepted on October 28,1997; Decision deadline is December 26,1997. <br /> <br />Prepared by: Kim L.
