The MGM liquor store is a solid building shielded from the back by
a barrier fence-solid wood, at least lOft. high. An alley separates the commercial businesses and
most of the homes have garages facing the alley. As I stood on the location of our proposed
building, I saw only one window facing north. Most the homes were hidden, up to roofline, by the
wooden fence. That one window also has a tree located in front of it.

I'm not even sure that sound could travel in the directions that citizens descnDed at the last
meeting. The Taco Bell building will also be lower than street level and, in the near future, have
additional landscaping along Larpenteur.

The planning commission compleDlented my company for the efforts made to date OD this project
and the planning commissioD on a 7-0 vote approved the project. However, the issue of hours
still remains outstanding for approval from the city council. We have incurred additional building
costs due to the architectural requirements for the PUD. Presentation material expenses for city
meetings continue to accumulate.

You have asked for a compromise on the hoW'S of operation. After discussion with Lee Engler, I
will agree to closing hours that are consistent with other businesses operating in the area and do
not force us to operate at a competitive disadvantage.

Those closing hours are: 12 Midnight Sun-Thurs.; I AM Fri.-Sat.

I hope that this concession will be sufficient to allay the fears of the neighbors and the city council
as I feel it is reasonable and in keeping with the policy of hours which have been. established or
allowed for other business in the immediate vicinity.

Sincerely,

f:Y&

Director of Development

Cc: Lee Engler.
