<br />3.0 Planned Unit Development and Plat Approval <br /> <br />The CITY hereby grants approval of the final development plan for Roseville Center <br />Planned Unit Development, subject to the DEVELOPER's compliance with the terms and <br />conditions of this agreement. The CITY also grants approval of the plat for Roseville <br />Center. The CITY agrees to approve applications for building permits, provided that said <br />plans are consistent with the exhibits which were approved at the concept and final stage <br />of the Planned Unit Development process, and all of the standards and conditions of this <br />agreement have been satisfied. <br /> <br />For two (2) years from the date of this Agreement, no amendments to the CITY'S <br />Comprehensive Guide Plan or official controls shall apply to or affect the use, development <br />density, site layout, or dedication requirements of the land included within the approved <br />plat unless required by state or federal law or agreed to in writing by the CITY and the <br />DEVELOPER. Thereafter, notwithstanding anything in this Agreement to the contrary, the <br />CITY may require compliance with any amendments to the City's Comprehensive Guide <br />Plan, official controls, platting or dedication requirements enacted after the date of this <br />Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD and the final plat for Roseville Center, <br />the CITY hereby incorporates the following exhibits. The DEVELOPER shall develop the <br />subject property as described or shown in these exhibits. If the exhibits vary from the <br />written terms of this Agreement, the written terms shall control. The exhibits marked as <br />approved by the City Council on February 9, 1998, or as amended thereafter, shall include: <br /> <br />A. Preliminary and Final Plat (Roseville Center) <br />B. Site Development Plan (being modified to reflect angle parking east of Center) <br />C. Detail Site Development Plan - Taco Bell (Lot 2) <br />D. Preliminary Landscape Plan <br />E. Building and Sign Elevations - Center <br />F. Building Elevations - Taco Bell <br />G. Sign Details - Center <br />H. Roseville Center Sign Criteria <br />I. Development Schedule (being prepared by Bradley) <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on November 12, 1997 (Planning Commission <br />- sketch plan review), November 17, 1997 (City Council- sketch plan review), December <br /> <br />PUD/Subdivision Agreement #_ (Roseville Center.) - Page 2 of 11 <br />
