' <br /> <br />CITY OF ROSEVILLE <br />PLANNED UNIT DEVELOPMENT/SUBDIVISION AGREEMENT #1199 <br /> <br />AGREEMENT, dated March 10, 1998, between the City of Roseville, a Minnesota <br />municipal corporation (herein referred to as "CITY"), and Bradley Operating Limited <br />Partnership, a Delaware Limited Partnership (herein referred to as "DEVELOPER"). <br /> <br />1.0 Effective Date of Agreement <br /> <br />This agreement shall be effective upon completion of the following: 1) passage and <br />publication of Ordinance #1199 (Rezoning of Property to PUD); 2) execution of this <br />agreement by the CITY; 3) recording of the final plat and this agreement with Ramsey <br />County; and 4) execution of a financial assistance agreement by the CITY for <br />improvements on and adjacent to the site. <br /> <br />2.0 Request for Planned Unit Development and Plat Approval <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) <br />(PF#2963) consisting of an existing 76,000 square foot (approximate) multi-tenant retail <br />center (Lot 2), a free-standing 2,150 square foot (approximate) restaurant on the site <br />formerly occupied by Fina Petroleum (Lot 1), and a building pad for a future tenant on the <br />site formerly occupied by Margolis Nursery (Lot 3). In conjunction with the PUD, the <br />DEVELOPER has also asked the CITY to approve the plat for Roseville Center, a three-lot <br />subd~v~sion of the total 6.35 acres. The subject property is generally located west of <br />Lexington Avenue and north of Larpenteur Avenue, and is legally described as follows: <br /> <br />The _~~OSeWIe Center, also legally described as: the Westerly 251.73 feet of the <br />Easterly 800.46 feet of the Southeast Quarter of the Southeast Quarter of Section 15, <br />Township 29 North, Range 23 West, Ramsey County, Minnesota, except the Northerly <br />767 feet, and except the Southerly 369.89 feet thereof, the Westerly boundary line of <br />said tract being the center line of Dunlap Street; subject to highway easement over the <br />North 33 feet thereof. Also the East 800.46 feet of the South 369.89 feet of the <br />Southeast Quarter of the Southeast Quarter part of Section 15, Township 29 North, <br />Range 23 West, Ramsey County, Minnesota; said tract extending from the center line <br />of Lexington Avenue to the center line of Dunlap Street; all according to the <br />Government Survey thereof, and except for those portions taken by the State of <br />Minnesota for highway purposes (PINs are 15-29-23-44-0006, 15-29-23-44-0007, 15- <br />29-23-44-0008, and 15-29-23-44-0057). <br /> <br />3.0 Planned Unit Development and Plat Approval <br /> <br />The CITY hereby grants approval of the final development plan for Roseville Center <br />Planned Unit Development, subject to the DEVELOPER's compliance with the terms and <br /> <br />PUD/Subdivision Agreement #1199 (Roseville Center) - Page 1 of 11 <br /> <br />" <br />
