<br />zoning district, may be approved by the CITY's Development Review Committee, under <br />the direction of the Community Development Director. Substantial departures from the <br />approved final development plans will require an amendment to the Planned Unit <br />Development in accordance with Section 1015 of the Roseville Zoning Ordinance. Where <br />not superseded by more restrictive requirements of this PUD, the standards of the <br />underlying SC (Shopping Center) zoning district shall apply, as stated in Chapter 1006 of <br />the Roseville City Code. Interior changes, including the re-configuration of tenant space, <br />shall be exempt from this provision. <br /> <br />6.0 Development of Property <br /> <br />Failure by the DEVELOPER to commence development activity, in accordance with the <br />final development plans, within one year following the final approval of this Planned Unit <br />Development, will necessitate the approval of an extension of the development schedule <br />by the City Council prior to the expiration of the one year period. If an extension is not <br />applied for, the Council may instruct the Planning Commission to initiate rezoning to the <br />original SC and 81 zoning districts. For purposes of this provision, development activity <br />shall be defined as obtaining a building permit and beginning construction on the site. <br /> <br />Development of the property and installation of improvements shall be in accordance with <br />the development schedule provided by the DEVELOPER and approved by the CITY <br />(Exhibit H). <br /> <br />7.0 Compliance with Laws and Regulations <br /> <br />The DEVELOPER represents to the CITY that any site improvements pursuant to the <br />proposed Development will comply with all City, County, Regional, Metropolitan, State, and <br />Federal laws and regulations, including but not limited to the Roseville Subdivision <br />Regulations, the Roseville Zoning Regulations, and all other applicable environmental <br />regulations. The DEVELOPER agrees to comply with all such laws and regulations. <br /> <br />8.0 Subdivision Requirements/Standards <br /> <br />To insure that the proposed plat meets the CITY'S requirements for subdivision approval, <br />as set forth in Title 11 of the City Code, the following provisions shall apply: <br /> <br />8.1 Subdivision of Land. The property shall be subdivided as shown on the preliminary <br />and final plat of Roseville Center (Exhibit A). Said plat shall include a 16.5 foot <br />right-of-way easement for Lexington Avenue along the eastern edge of Lot 2, the <br />dedication of a 10 foot pedestrian walkway and streetscape easement over the <br />eastern edge of Lot 1, the dedication of a five foot pedestrian walkway and <br />streetscape easement over the southern edge of Lot 1, a five foot streetscape <br />construction and maintenance easement over the southern edge of Lot 2, and the <br />dedication of utility easements as required by the Director of Public Works and <br />shown on the preliminary and final plats attached as Exhibit A.
