The DEVELOPER may continue to use a portion of the 16.5 foot right- <br />of-way easement along the eastern edge of Lot 2 for off-street parking consistent <br />with the approved site development/landscape plan (Exhibit B). <br /> <br />8.2 Park Dedication. CITY policy requires the dedication of park land or a payment in <br />lieu of land dedication for all subdivision, including planned unit development. The <br />DEVELOPER shall not be required to dedicate land or make a payment in lieu in <br />conjunction with plat approval, since the previously developed property is being <br />reconfigured and no additional buildable lots are being created. <br /> <br />9.0 Site Development Requirements and Subdivision Standards <br /> <br />To ensure that the proposed development meets the CITY'S requirements and standards <br />for site development, the following provisions shall apply: <br /> <br />9.1 Final Grading Plan. The final grading plan for Lot 1 must be reviewed and approved <br />by the Director of Public Works prior to any permits being issued for this building <br />pad. The final grading plan for Lot 3 must be reviewed and approved by the <br />Director of Public Works prior to any permits being issued for this building pad. All <br />grading shall comply with the approved grading plans and shall be the responsibility <br />of the DEVELOPER. <br /> <br />9.2 Final Utility SeNicing Plan. The final utility servicing plan for Lot 1 must be reviewed <br />and approved by the Director of Public Works prior to any permits being issued for <br />these projects. The final utility servicing plan for Lot 3 must be reviewed and <br />approved by the Director of Public Works prior to any permits being issued for these <br />projects. <br /> <br />9.3 Erosion Control. Prior to site grading, and before any utility construction is <br />commenced or building permits are issued, an erosion control plan must be <br />submitted for approval, and all erosion control actions shall be implemented, <br />inspected and approved by the CITY. <br /> <br />9.4 Clean Up. The DEVELOPER shall clean dirt and debris from streets that has <br />resulted from construction work by the DEVELOPER, its agents or assigns. The <br />CITY will determine whether it is necessary to take additional measures to clean dirt <br />and debris from the streets. After 24 hours verbal notice to the developer, the CITY <br />may complete or contract to complete the clean up at the DEVELOPER'S expense. <br /> <br />9.5 Street Trees. CITY policy requires the planting of street trees in conjunction with <br />commercial development; however, the DEVELOPER shall not be required to install <br />street trees, as the entire streetscape along Lexington Avenue and Larpenteur <br />Avenue will be redeveloped in conjunction with street reconstruction and resurfacing <br />projects over the next three years. <br /> <br />PUD/Subdivision Agreement #1199 (Roseville Center) - Page 4 of 11 <br />
