As a condition to <br />approving an ab::ttem'ent, the jurisdiction must determine that the benefits to <br />it from granting the abatement are not less than the costs of the abatement. <br />The abatement resolution must specifically describe the nature and extent of <br />the benefits. The cost/benefit analysis from the TIF law (that the expected <br />increase in taxable market value exceeds the present value of the increment <br />for the life of the TIF district) would presumably be one way to satisfy this <br />requirement, but this may not apply in all abatement-eligible situations where <br />the benefit is less tangible, e.g., redevelopment or public facilities. <br /> <br />The jurisdiction must also determine that granting the abatement is in <br />the public interest because it \\111 satisfy at least one of the following: <br /> <br />. Increase or preseIVe the tax base; <br />. Provide employment opportunities in the jurisdiction; <br />. Provide, help acquire, or construct public facilities; <br />. Help redevelop or renew blighted areas; or <br />. Help provide access to services for residents of the jurisdiction <br /> <br />Though not required by the law, as a matter of good practice each of <br />these findings should be accompanied by a statement of the particulars which <br />justify it, but the "reasons and supporting facts", "studies and analyses" and <br />other more particular requirements that apply to various TIF findings are not. <br />statutorily required for abatement. <br /> <br />2. Public Hearing Notice. Each jurisdiction must have a public <br />hearing on the proposed abatement. Notice of the hearing must be published <br />once at least 10 and not more than 30 days before the hearing in a newspaper <br />of general interest and readership in the community "and not one of limited <br />subject matter." The newspaper must be at least a weekly. The notice must <br />indicate the date, time and place of the meeting at which the abatement <br />hearing will be held. The notice must identify the properties being considered <br />for abatement and the total estimated amount of the abatement. <br /> <br />369177.1 <br /> <br />3 <br />
