<br />plans are consistent with the exhibits which were approved at the concept and final stage of <br />the Planned Unit Development process, the DEVELOPER has not defaulted, and all of the <br />standards and conditions of this agreement have been satisfied. <br /> <br />For three (3) years from the date of this Agreement, no amendments to the CITY'S <br />Comprehensive Guide Plan or official controls shall apply to or affect the use, development <br />density, site layout, or dedication requirements of the land included within the approved plat <br />unless required by state or federal law or agreed to in writing by the CITY and the <br />DEVELOPER. For any improvements proposed thereafter, notwithstanding anything in this <br />Agreement to the contrary, the CITY may require compliance with any amendments to the <br />City's Comprehensive Guide Plan, official controls, platting or dedication requirements <br />enacted after the date of this Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD and the final plat for Roseville Center, <br />the CITY hereby incorporates the following exhibits. The DEVELOPER shall develop the <br />subject property as described or shown in these exhibits. If the exhibits vary from the <br />written terms of this Agreement, the written terms shall control. The exhibits marked as <br />approved by the City Council on March 10, 1998, or as amended thereafter, shall include: <br /> <br />A. Final and Preliminary Plat (Roseville Center) <br />B. Site Development/Landscape Plan <br />C. Detail Site Development/Landscape Plan - Lot 1 <br />D. Building and Sign Elevations - Roseville Center <br />E. Building Elevations - Lot 1 <br />F. Sign Details - Roseville Center <br />G. Roseville Center Sign Criteria <br />H. Development Schedule (All improvements to be completed within three years) <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on November 12, 1997 (Planning Commission <br />- sketch plan review), November 17, 1997 (City Council- sketch plan review), December <br />10, 1997 (Planning Commission - hearing on concept development plan), January 14, 1998 <br />(Planning Commission - continued hearing concept development plan and preliminary plat), <br />January 26, 1998 (City Council - meeting on concept development plan and preliminary <br />plat), February 9, 1998 (City Council- hearing on final development plan and final plat), and <br />March 10, 1998 (City Council - action on final development plan and final plat) to consider <br />various aspects of the Planned Unit Development, including the plat of the subject property <br />and rezoning of the subject property from SC Shopping Center and B-1 Limited Business to <br />PUD Planned Unit Development. The CITY agrees to rezone the subject property to PUD, <br />subject to the DEVELOPER's strict compliance with the approved plans, and the terms and <br />conditions of this agreement. Minor variations from the approved final development plans, <br />which are consistent with this agreement and the underlying SC zoning district, may be <br />approved by the CITY's Development Review Committee, under the direction of the <br />Community Development Director. Substantial departures from the approved final <br />development plans will require an amendment to the Planned Unit Development in <br />accordance with Section 1015 of the Roseville Zoning Ordinance.
