<br />2.3 An application for plan review has been submitted to the State Fire Marshal and a <br />notification form has been submitted to the Minnesota Pollution Control Agency. <br /> <br />2.3 Section 902.06A of the City Code, which regulates the storage of flammable liquids, <br />states that the storage of flammable liquids in outside aboveground tanks is <br />prohibited in all areas other than that area bounded by Cleveland Avenue, Highway <br />36, the northern City limits, and the western City limits. <br /> <br />Section 902.06C of the City Code states, "notwithstanding the limits for <br />aboveground storage tanks established in subsections A and B above, such storage <br />tanks in other non-residentially zoned areas may be allowed by issuance of a permit <br />approved by the City Council. The permit is subject to review and <br />recommendations of the Fire Marshal and to conditions imposed by the City <br />Council." This subsection also outlines the requirements and standards for above <br />ground storage tanks allowed under this provision. <br /> <br />3Jl STAFF RECOMMENDA TION <br /> <br />3.1 Staff recommends approval of the installation one 8,000 gallon Convault above <br />ground diesel tank and one 1,000 gallon Convault above ground gasoline tank, with <br />the following conditions: <br /> <br />1. The proposed 8,000 gallon and 1,000 gallon above ground storage tanks <br />must be approved by the State Fire Marshall. <br /> <br />2. The above ground tanks must be installed as shown on the approved site <br />plan and must be screened from eye level view from adjacent properties and <br />public streets by buildings, landscaping, or a screen wall. Any screen walls <br />shall be constructed of the similar and compatible materials to that of the <br />principal structure. <br /> <br />3. The site and tank permit shall be reviewed by the City's Fire Marshal on an <br />annual basis, with a report being submitted to the City Council. <br /> <br />4. The above ground storage tank permit shall be valid for a period of five years <br />from the date of approval by the City Council. Thereafter, the applicant may <br />apply for an annual one year extension of the permit. <br /> <br />5. The City Council may terminate the permit for noncompliance or require <br />additional improvements consistent with Subsection 902.06C of the City <br />Code. <br /> <br />4.J2 COUNCIL ACTION SUGGESTED <br /> <br />4.1 By motion, approve the installation of one 8,000 gallon Convault above ground <br />diesel tank and one 1,000 gallon Convault above ground gasoline tank at 1717 <br />County Road C, subject to the conditions outlined in Section 3.1 of this report. <br /> <br />RCA (PF2965) - 09/22/97 - Page 2 of 3 <br />
