After reviewing your request, and after considering the recommendations of Roseville Fire Marshal John Loftus, the Roseville City Council and the Fire Marshal Code Advisory Panel, I have reached the following decision: Your request for a variance from MUFC(91), Sec. 79.903(a)1, as amended, to allow the use of one 8,000 gallon, two-hour fire-rated, Convault aboveground tank for the storage and dispensing of diesel fuel into the fuel tanks of motor vehicles at Laidlaw Transit in Roseville is granted, provided the following conditions are met: a. Except for tank size and dispenser location, the tank installation must be in conformance with MUFC(91), Sec. 79.903(a), as amended by M.R. 7510.3440, subp. 5, and all other applicable provisions of the code; b. The tank must be located and maintained at least 30 feet from the nearest building, public way and property lines that may be built upon; c. If any type of screened enclosure is installed around the tank, access into the enclosure for firefighting purposes must be provided as required by the Roseville Fire Marshal; d. The dispensing area must be well lighted; e. Dispensing must be for private use only and be done by trained employees; f. The installation must be in conformance with all requirements established by the Roseville City Council at its meeting on September 22, 1997; and g. Provision must be made either to automatically stop the delivery of fuel into the tank when the liquid level in the tank reaches 90 percent of capacity or to sound an audible alarm when the liquid level in the tank reaches 85 percent of capacity.
