After reviewing your request, and after <br />considering the recommendations of Roseville Fire Marshal John Loftus, the Roseville City Council and <br />the Fire Marshal Code Advisory Panel, I have reached the following decision: <br /> <br />Your request for a variance from MUFC(91), Sec. 79.903(a)1, as amended, to allow the use of <br />one 8,000 gallon, two-hour fire-rated, Convault aboveground tank for the storage and dispensing of <br />diesel fuel into the fuel tanks of motor vehicles at Laidlaw Transit in Roseville is granted, provided <br />the following conditions are met: <br /> <br />a. Except for tank size and dispenser location, the tank installation must be in conformance with <br />MUFC(91), Sec. 79.903(a), as amended by M.R. 7510.3440, subp. 5, and all other <br />applicable provisions of the code; <br /> <br />b. The tank must be located and maintained at least 30 feet from the nearest building, public way <br />and property lines that may be built upon; <br /> <br />c. If any type of screened enclosure is installed around the tank, access into the enclosure for <br />firefighting purposes must be provided as required by the Roseville Fire Marshal; <br /> <br />d. The dispensing area must be well lighted; <br /> <br />e. Dispensing must be for private use only and be done by trained employees; <br /> <br />f. The installation must be in conformance with all requirements established by the Roseville City <br />Council at its meeting on September 22, 1997; and <br /> <br />g. Provision must be made either to automatically stop the delivery of fuel into the tank when the <br />liquid level in the tank reaches 90 percent of capacity or to sound an audible alarm when the <br />liquid level in the tank reaches 85 percent of capacity. <br /> <br />AN eaUAL OPPORTUNITY EMPLOYER <br />
