The location of the house, which was built in 1890, and the location of the <br />windows on the house creates a practical difficulty for the applicant. <br />Adequate light must be provided in the kitchen area and egress windows <br />must be provided for bedrooms in accordance with the Uniform Building <br />Code. The proposed location of the attached garage will not interfere with <br />these requirements. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent <br />of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The proposed variance, if granted, will not adversely affect the public <br />health, safety, or general welfare. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the <br />City of Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a variance to <br />reduce the setback of an attached garage to three feet from the rear property line and <br />four feet from the side property line at 2416 Lexington Avenue North be granted, with <br />the following provisions: <br /> <br />1. The driveway must be hard-surfaced in conjunction with construction of <br />the garage in accordance with Section 703.04(B)(7) of the City Code <br /> <br />2. A vehicle turnaround area must be constructed in accordance with <br />Section 703.04(B)(10) of the City Code, since Lexington Avenue is a <br />County roadway. If this area provides a turnaround/parking area for more <br />than two vehicles, screening from Lexington Avenue must be installed.. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Council Member Mastel, and upon vote being taken thereon, the following voted in <br /> <br />favor: Mastel, Maschka, Goedeke, Wiski, Wall <br /> <br />and the following voted against the same: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />Resolution 9510 - Page 2 of 2 <br />
