<br />J.Jl MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, a sketch of the <br />property and proposed fence, a written statement from the applicant, and written <br />approval from the adjacent property owner affected by the variance (Steve and <br />Sharon Kinsel at 2122 Hand Avenue). <br /> <br />3.2 The Minor Variance Committee reviewed this request on November 4, 1997, and <br />unanimously recommended approval of a minor variance to reduce the side yard <br />setback to six feet for the purpose of replacing an attached single car garage with <br />the an attached two car garage at 2130 Hand Avenue, based on the following <br />findings: <br /> <br />1. The topography of the parcel limits options for the location of a second <br />garage stall and creates a practical difficulty for the applicant. <br /> <br />2. The property is one of two properties requiring a ten foot side yard setback <br />within blocks of properties requiring only a five foot side yard setback <br />(parcels platted prior to 1959 only require a five foot side yard setback, while <br />parcels platted since that time are subject to the current ten foot side yard <br />setback requirement). <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />4. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />~ SUGGESTEDACnON <br /> <br />4.1 By motion, approve Michael Daly's request for a variance to reduce the side yard <br />setback to six feet for the purpose of replacing an attached single car garage with <br />the an attached two car garage at 2130 Hand Avenue, based on the findings of the <br />Minor Variance Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owner; sketch of property; photograph of property. <br /> <br />60-day Time Limit: Application accepted on October 31,1997; Decision deadline is December 30,1997. <br /> <br />Prepared by: Kim L.
