<br />/ <br /> <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVlLLE <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly called held at the City Hall on Monday, the 26th <br />day of January, 1998, at 6:30 P.M. <br /> <br />The following members were present: Maschka, Mastel, Wall, and Wiski, and the following <br />were absent: Goedeke. <br /> <br />Council Member Wiski introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 9517 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT <br />FOR TAKE-OUT/SELF-SERVlCE RESTAURANT (ARBY'S/SBARRO) <br />AT 2105 SNELLING AVENUE NORTH <br /> <br />WHEREAS, Section 1005.05C of the Roseville City Code identifies take out and self service <br />restaurants as a conditional use in a B3 General Business district; and <br /> <br />WHEREAS, Franchise Associates, Inc. requested a conditional use permit to allow the <br />construction and operation of a new take-outlself-service restaurant (Arby's/Sbarro) at 2105 <br />Snelling Avenue North; and <br /> <br />WHEREAS, the Roseville Planning Commission conducted a public hearing on the request <br />on Wednesday, January 14,1998, and recommended approval of the requested conditional use <br />permit subject to conditions; and <br /> <br />WHEREAS, the Roseville City Council received the Planning Commission's <br />recommendation on Monday, January 26, 1998; and <br /> <br />WHEREAS, the Roseville City Council made the following findings: <br /> <br />1. The redevelopment of the site as proposed will have a minimal impact on traffic in the area, <br />as the use of the property will not be changing. <br /> <br />2. The proposed redevelopment of the property as proposed will not have an impact on parks, <br />streets and other public facilities. <br /> <br />3. The redevelopment of the property as proposed will be compatible with contiguous <br />properties, with the exception of the pre-existing non-conforming freestanding sign. Access <br />and egress will be improved, sight lines along the frontage road will be improved, internal <br />traffic circulation will be improved, the overall appearance will be improved, and landscaping <br />of the site will be improved. An existing six foot board on board fence and over-story trees <br />along the western property line provide an adequate screen from the adjacent high density <br />residential uses to the west. <br /> <br />Resolution 9517 - Page 1 of 3 <br />
