<br />4. The redevelopment of the property as proposed will not have an adverse impact on the <br />market value of contiguous properties. <br /> <br />5. The redevelopment of the property as proposed will not have an adverse impact on the <br />general public health, safety and welfare. <br /> <br />6. The redevelopment of the property as proposed is consistent with the City of Roseville's <br />Comprehensive Plan and Title 10 of the City Code (Zoning), including the City's design <br />standards, with the exception of the pre-existing non-conforming freestanding sign. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a conditional use permit to allow <br />the construction and operation of a new take-outlself-service restaurant (Arby's/Sbarro) at 2105 <br />Snelling Avenue, be approved subject to the following conditions: <br /> <br />1. The site must be developed in accordance with the final plans (site plan dated 01/07/98, <br />construction plan dated 12/30/97, demolition plan dated 12/30/97, directional signage plan <br />dated 12/30/97, building elevation and materials plan dated 12/15/97, and landscape plan <br />dated 01/07/98) submitted and approved in conjunction with the request for a conditional <br />use permit. Minor variations from the approved plans may be approved by the City's <br />Development Review Committee, under the direction of the Community Development <br />Director; however, any substantial departures from the approved plans will require an <br />amendment to the conditional use permit. <br /> <br />2. Prior to a building permit being issued for the project, the applicant must provide the City <br />with written permission/approvals that off-street parking for employees and construction <br />workers will be provided on another site. Such documentation may include parking <br />agreements with adjacent property owners. .~ <br /> <br />3. Final grading and utility plans must be reviewed and approved by the Public Works Director. <br />An erosion control plan must be developed and erosion control must be in place prior to <br />grading of the site. Since the site is less than 2.5 acres in size, it is unlikely that on-site <br />ponding will be required by the Rice Creek Watershed District; however, the applicant will <br />need to contact the District for permit requirements. <br /> <br />4. All site lighting, including lighting for the parking area and exterior building lighting, must <br />comply with the requirements of Section 1010.12 of the City Code. A lighting plan must be <br />submitted to and approved by the City in conjunction with application for a building permit. <br /> <br />5. A detached trash enclosure will be allowed, provided it is constructed of the same or similar <br />masonry materials as the principal structure and roofed in accordance with Section 1010.14 <br />of the City Code. <br /> <br />6. All signage for the project must comply with the current requirements of Section 1009 of <br />the City Code, including the size and location of wall signs and directional signs. <br /> <br />7. The existing sidewalk along the front property line shall be improved and/or replaced if <br />required by the City in conjunction with site development or construction damage. <br />Pedestrian access must be provided from this sidewalk to the front door of the building via <br />a paved pedestrian surface. <br /> <br />Resolution 9517 - Page 2 of 3 <br />
