<br />Mr. Malkerson's letter also indicated that his client would be willing to use the <br />existing sign face at a setback and a height in conformance with the current sign <br />regulations. <br /> <br />3.0 STAFF RECOMMENDA TION <br /> <br />The staff recommends (after review with the City Attorney on possible legal <br />complications) that the conditional use permit be clarified so that the applicant may <br />move the existing pylon sign - for which a permit was issued in 1972 - to meet the <br />setback and height requirements of the current code, but retain the same overall <br />size. <br /> <br />4.0 SUGGESTED CITY COUNCIL ACTION <br /> <br />4.1 By motion, provide direction to the Community Development Director to interpret <br />condition 6 of Resolution 9517 to allow the existing Arby's pylon sign (which <br />received a permit in 1972) to remain on the site if it is moved to meet the setback <br />and height requirements of the City's sign regulations, and with the understanding <br />that the size of the sign would remain as a non-conformity. <br /> <br />Prepared by: Dennis Welsch (490-2232) and Kim Lee (490-2236) <br />M:\RCA\PF2977SI <br /> <br />PF#2977 - RCA (04/13/98) - Page 2 of 2 <br />
