("FAIn).

The conditional use application was for PAI's entire property at 2105 Snelling Avenue-
North, which includes the pilon sign.

The code criteria for the Council's consideration of a CUP is set forth in ~ 1013.01D.
This section says the Council "shall consider the following criteria:... (3) Compatibility of the
site plan... and the structures with contiguous properties... (6) Compatibility with the City's
Comprehensive Plan." Part F of this Section allows the Council to attach reasonable conditions
which shall constitute a fmding that the conditions are necessary and reasonable.

This is the basis for the Council's decision to add Condition #6 to the CUP which was
granted to FAI. Including this condition is clearly supported by the record before the City
Council. This record includes staff fmdings that the site plan and the structures are compatible
with contiguous properties, except for the pilon sign. The staff also found that the site plan and
structures were compatible with the Comprehensive Plan, again with the exception of the pilon
sign. The Council then engaged in a great deal of discussion with regard to these two criteria.
Specifically, they discussed the objective of the code and the Comprehensive Plan to eradicate

* Also Admitted in Wisconsin
tCivil Trial Specialist, Cenified by the Civil Litigation Section of the Minnesota State Bar Association.
