<br />~o PLANmNGCOMM/S~ONACnON <br /> <br />5.1 On January 14, 1998, the Planning Commission held a public hearing on the <br />request. Doug Kennedy, Franchise Associates, and Scott Mower, project architect, <br />were present to answer questions and provide additional informaion. No residents <br />present commented on this request. <br /> <br />5.2 The Planning Commision discussed traffic circulation on the site, the potential for <br />extending the access on the west side of properties in this area (County Road B to <br />Arby's) through the Arby's site and south to McDonald's, the need to replace <br />existing non-conforming pylon sign in conjunction with the project, the impact of <br />keeping the existing facility open while the new facility is being constructed, the <br />detached trash enclosure as shown on the site plan, the appearance of the new <br />facility, and the possibility of burying or moving the overhead power lines along the <br />frontage road. Replacement of the existing non-conforming pylon sign was <br />discussed at length. <br /> <br />5.3 The Planning Commission recommeded approval of the request for a conditional <br />use permit to allow the construction and operation of a new take-outlself-service <br />restaurant (Arby's/Sbarro) at 2105 Snelling Avenue North, based on the findings <br />outlined in Section 3.1 of this report and with the 11 conditions outlined in Section <br />4.1 of this report, with condition #6 amended as follows (6-1): <br /> <br />6. The existing non conforming pylon sign for Arby's will be allowed to remain, <br />with the face of the reader board portion being replaced to allow pylon <br />signage for 8barro. All etheF signage for the project must comply with the <br />current requirements of Section 1009 of the City Code, including the size <br />and location of wall signs and directional signs. (Change by Planning <br />Commission) <br /> <br />6.0 SUGGESTED CITY COUNCIL ACTION <br /> <br />6.1 By resolution, approve the request for a conditional use permit to allow the <br />construction and operation of a new take-outlself-service restaurant (Arby's/Sbarro) <br />at 2105 Snelling Avenue North, based on the findings outlined in Section 3.1 of this <br />report and with the 11 conditions outlined in Section 4.1 of this report, as modifed. <br /> <br />Attachments: location map; notification map; notice of public hearing; proposed site development plans; site <br />plan; construction site plan; building elevations; building floor plan; landscape plan; signage plan; and <br />photographs of property. <br /> <br />60-day Time Limit: application submitted on December 15, 1997; application accepted as complete on <br />December 23, 1997; decision deadline is February 13, 1998. <br /> <br />Prepared by: Kim L.
