<br />encroachment of commercial uses into residential neighborhoods. The <br />transfer of the west .54 acres of the McDonald's parcel to the adjacent <br />multi-family parcel, along with the designation of the .54 acres as high <br />density residential and the rezoning of the parcel to R3A, will remove the <br />commercial encroachment into a residential area. <br /> <br />3. A minor subdivision to transfer this property from 2075 Snelling Avenue <br />North (McDonald's - land owned by applicant) to 2096 Fry Street North <br />(four-plexes - land owned by applicant) was approved by the City Council <br />on September 8, 1997, subject to approval of a comprehensive plan <br />amendment and rezoning of the parcel. <br /> <br />4. A request for a comprehensive plan amendment to change the <br />designation of this parcel from Business to High Density Residential was <br />recommended for approval by the Planning Commission on December 10, <br />1997, and is scheduled for City Council action on January 12, 1998. <br /> <br />5. The proposed rezoning is in harmony with the general purpose and intent <br />of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The proposed rezoning will not adversely affect the public health, safety, <br />or general welfare. <br /> <br />Motion carried 7-0. <br /> <br />6d. Planning File 2977. Arby's Restaurant, a request for a Conditional Use <br />Permit to allow the reconstruction of a convenience food restaurant (2105 <br />Snelling Avenue North). <br /> <br />Chairperson Wietecki opened the hearing and requested City Planner Kim Lee <br />summarize her written report of January 14, 1998. <br /> <br />Ms. Lee described the request and a neighborhood meeting on January 7. The <br />public did not comment at that time. She explained the existing conditions and <br />the proposal to keep the existing business in operation while the new business is <br />constructed. There would be 31 parking spaces for customers during <br />construction of the 4.000 square foot facility. The circulation, building materials, <br />and landscape plan were reviewed. The applicant feels the improvement of the <br />access way would be detrimental to the Arby's site and easements. <br /> <br />The pre-existing, non-conforming signage was described by Ms Lee. <br /> <br />Staff recommended approval with 11 conditions. <br /> <br />6 <br />
