<br />12. The preliminary plat and proposed project will not adversely affect the <br />public health, safety, or general welfare. <br /> <br />Motion carried 7-0. <br /> <br />6b. Planning File 2958. Patricia Halverson (NIPS, Inc.) a request for a rezoning <br />of a .54 acre portion of a parcel from B3 (General Business) to R-3A (3 to 24 <br />Family Residential). <br /> <br />Chairperson Wietecki opened the hearing and requested City Planner Kim Lee to <br />summarize her written report of January 14,1998. <br /> <br />Ms. Lee explained that this is the third step in a process to allow a rebuilding of <br />the McDonalds Restaurant. The comprehensive plan and subdivision have <br />already been approved. The play area behind McDonalds is no longer needed, <br />since a complete rebuild will include an interior play land. Staff recommended <br />approval of the rezoning. <br /> <br />Chair Wietecki asked if the City had undertaken a comprehensive traffic study for <br />the area along the west property line of all fast food businesses along Snelling, <br />Kim Lee stated that the staff had reviewed the possible solutions and found that <br />the only method may be condemnation in order to construct an alley or access <br />way. <br /> <br />Chair Wietecki urged staff and Council to work with property owners on a traffic <br />study and if needed, utilize eminent domain to acquire the alley/access way. <br /> <br />Craig Barnes, of McDonalds, stated that he agreed with the staff report. <br /> <br />There were no further comments. Chair Wietecki closed the hearing, <br /> <br />Motion: Member Harms moved, Member Rhody seconded, to recommend <br />approval of the request for rezoning of the west .54 acre of the parcel located at <br />2075 Snelling Avenue North from 83, General Business, to R3A, Three to <br />Twenty-Four Family residential, based on the following findings, and contingent <br />upon the comprehensive plan designation being changed to HR, High Density <br />residential: <br /> <br />1. The City's Comprehensive Plan map designates the entire parcel located <br />at 2075 Snelling Avenue North as Business and the entire parcel located <br />at 2096 Fry Street North as High Density Residential. <br /> <br />2. The City's Comprehensive Plan text does not specifically address this <br />parcel; however, it is the policy of the City to discourage the <br /> <br />5 <br />
