Hamline Avenue is a good location for the transition. <br /> <br />There were no further public comments, Chairperson Wietecki closed the <br />hearing. <br /> <br />Motion: Member Wietecki moved, Member Mulder seconded, to recommend <br />denial of the request based on: <br /> <br />1. The City's Comprehensive Plan map designates the six parcels along <br />Hamline Avenue as Medium Density Residential and the interior parcel as <br />Low Density Residential. <br /> <br />2. The text of the City's Comprehensive Plan specifically address this parcel <br />(Site #13-3). In 1994, the Council's decision was to change the land use <br />designation of this site from Low Density Residential to Medium Density <br />Residential, with site design to be reviewed through a planned unit <br />development approach, The Council's decision also specifically stated <br />that the Medium Density Residential designation does not include land <br />east of the lots which front on Hamline Avenue. <br /> <br />3. The applicant has not demonstrated that any factors affecting the City's <br />decision on these properties have changed. In addition, while the <br />Comprehensive Plan is updated annually, the City has not seen any <br />changes in area conditions which would result in the land use designation <br />of this property being revisited. <br /> <br />4. The proposed comprehensive plan amendment is not in harmony with the <br />general purpose and intent of the City's Comprehensive Plan, as adopted <br />in 1994 and amended annually thereafter. <br /> <br />5. The proposed comprehensive plan amendment to change the land use <br />designation of the subject property (seven parcels) from Medium Density <br />Residential to Limited Business will adversely affect the public health, <br />safety, or general welfare. The de facto rezoning of the parcel to 81, in <br />accordance with consistency requirements of State Statutes, would <br />adversely impact the adjacent residential uses. In addition, the traffic <br />generated by a limited business use on this site would require Hamline to <br />be upgraded in order to accommodate the additional traffic. <br /> <br />Member Rhody stated his concern about bias and change in the comprehensive <br />plan. The applicants did not offer good reasons to change, Hamline Avenue is a <br />good place to make a transition into the neighborhood. <br /> <br />Member Mulder expressed concern that the Library is not a commercial use but <br /> <br />13 <br />
