<br />yard setback (20 feet) would have no greater visual mass than a three story <br />building at 150 feet which is the accepted standard. <br /> <br />10. All of the above supports the conclusion that the subject property is a <br />commercial office site that is capable of being developed in a manner that is <br />compatible with the adjoining Oellwood Heights residential area, which <br />development would be consistent with the City's standards governing <br />commercial-residential land uses relationships. <br /> <br />Preliminary Concept Plan (attached) <br /> <br />Item 20C of the Application form indicates that proposed plans are required to be <br />submitted with the application. For the record, we object to any requirement of the plan <br />submittal in connection with an Application to Amend the Comprehensive Plan, where <br />the application, as here, is not project specific and does not include a current rezoning <br />application. <br /> <br />We believe an applicant has the right to submit and process an Application for a <br />Comprehensive Plan Amendment independent of specific project plans, as the <br />amendment of the comprehensive plan can and should be "project neutral". <br />Nevertheless, in an effort to meet the submittal requirement, attached and submitted <br />with this application are copies of a preliminary, conceptual site plan depicting a <br />potential 3-story office building of approximately 51,100 square feet. This preliminary <br />site plan is submitted solely for the purpose of providing one depiction of how an office <br />building might be developed on the subject property, consistent with a redesignation of <br />the land use to Limited Business under the Comprehensive Plan. The applicant <br />acknowledges and states for the record that no specific office building plan has been <br />applied for in connection with this application, and that the attached conceptual site <br />plan is submitted only for illustrative and discussion purposes. The applicant is fully <br />aware that more detailed plans would be required for submittal, review and <br />consideration by the Planning Commission and City Council in connection with a future <br />rezoning application. <br /> <br />~xpected Impacts of "Project" <br /> <br />Again, applicant objects to the requirements set forth in Item 200 of the application, <br />requiring a project narrative, including an "explanation of the site planning, <br />landscaping, and architecture of project in detail including the need for the project, any <br />physical hardships. and the expected noise, air, drainage, lighting, waste management, <br />parking, and traffic impacts. ~ We object to this submittal requirement on the same <br />basis that an Application to Amend the Comprehensive Plan need not involve or <br />include a specific project proposal. Nevertheless, we will set forth a response to this <br />item, as follows: <br /> <br />The potential future redevelopment of the subject property for business or professional <br />office uses would meet an acknowledged need in the marketplace.
