Assuming he had received the fax, I called Tim Nelson on another <br />matter - to let him know that I had found his comprehensive plan change application for <br />the Hamtine Avenue site to be incomplete. The Everest request to be on the Planning <br />Commission hearing for December, 1997 would have to be set off to January, 1998 in <br />order for Everest to submit a complete application. Everest had not spoken with the city <br />planner but had simply faxed and sent in the application. (November 17, 1997 was the <br />10th day and last day in which to review completeness under the state statute. The <br />application was an outdated form, did not have a complete legal description or <br />narrative, mailing list, or building/site drawings except for the sketched received earlier <br />in the fall. Mailed and faxed copies were sent to Mr. Nelson by me. (Kim Lee, our city <br />planner, was sick with the flu this day. She would normally handle incomplete <br />applications like this.) <br /> <br />November 17, 1997. The Council work session at which I asked the Council for <br />direction (as per memo of 11/17/97). I asked the Council for direction on the three <br />issues; a change in land use, a change in the policy of commercial expansion, and a <br />tax increment policy change. I think the Council may have misunderstood my request <br />and thought it was a direct Everest request, but wondered aloud why Everest was not <br />present. <br /> <br />November 18, 1997. Tim Nelson called to ask why the Everest case had been <br />discussed by the Council. I was surprised and felt "set up" by him because he even <br />admitted that he received the mailed notice on Monday before the meeting but did not <br />open it or somehow left it on his desk. He accused staff of trying to deceive Everest and <br />create a negative meeting by notifying surrounding neighbors. In fact, staff had not <br />notified them either in writing or by phone; they started calling staff Monday wondering <br />what was on the agenda by Everest and when. I responded by explaining the concept <br />and the need for further staff direction before any hearings were held. Kim also talked <br />to Tim Nelson and sent him another copy of the agenda and the packet from November <br />17, 1997. <br /> <br />5 <br />
