January 14,1998. Nelson provided a list (dated 1/12/98) of 50 office or commerical
buildings adjacent to single family residences, claiming that this placement of business
was accepted practice in Roseville. Numerous mischaracterizations of the land use in
the list of 50 were noted by staff. It is precisely because of some of these poorly sited
projects adjacent to single family housing that the Vista 2000 and Comprehensive Plan
stated no further incursion into residential areas would be acceptable.

January 12, 1998. Letter of oppostion to the project from Eric Kwok, 2225 Dellwood.

January 13, 1998. Linda Owen article in Pioneer Press describing issues.

January 14, 1998. Planning Commission meeting and staff report dated 1/14/98 in
which staff recommends upholding the current comprehensive plan and denying the
request to change the designation on the site from residential to business.

January 14, 1998. Benshoof Traffic Report for Everest - presented and distributed at
the Planning Commission meeting, including reports from 1987 consultant report.

January 16, 1998. (via fax and mail) Everest letter of withdrawal stating the staff and
City Council are "...intent on discrediting and disadvantaging Everest, rather than
providing a neutral forum for judging a redevelopment opportunity on its merits" and
that staff "leaked" information to Council members. Everest again asserted that staff
lied to them about faxes and that staff was not unbiased and disregarded 1986 through
1992 information submitted as part of application; the staff traffic report was speculative
and deficient - Everest used 1985 data in their report; and staff "manipulation of the
planning process" to avoid a fair and neutral hearing of the Everest application on its
merits". Everest claims its application was well supported by planning principles (1986
through 1992)but with no mention of the current comprehensive plan. Everest/Nelson
misconstrued what Planning Commission Member John Thein had said about being a
"pawn" in a planning contest. Everest stated there is favoritism and special treatment.

January 21, 1998. Everest withdrawlletter was faxed to the Planning Commission by
staff because they were mentioned in letter.

8
