<br />2.4 Section 703.04B, City Code, states, "residential driveways shall be constructed so <br />that the edge of the driveway nearest to the side lot line shall be a minimum of five <br />feet from the side lot line." <br /> <br />3.0 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed driveway, written statement from the applicant, and written <br />approval from the adjacent property owner affected by the variance (Mr. & Mrs. <br />Ortwin Kolewe at 1122 Transit Avenue). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Tuesday, January 20, <br />1998, and unanimously recommended approval of a minor variance to reduce the <br />side yard setback of a driveway to one foot for the purpose of expanding an existing <br />driveway at 1132 Transit Avenue, based on the following findings: <br /> <br />1. The location of the existing driveway/parking area creates a practical <br />difficulty for the applicant. <br /> <br />2. The recreational vehicle will continue to be stored in line with the front of the <br />house on the property; therefore, the storage of the vehicle is this location <br />complies with Section 407.03, City Code. <br /> <br />3. The width of the driveway will not exceed 26 feet at the property line. <br /> <br />4. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />5. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 SUGGESTEDACnON <br /> <br />4.1 By motion, approve Gordon Miller's request for a minor variance to reduce the side <br />yard setback of a driveway to one foot for the purpose of expanding an existing <br />driveway at 1132 Transit Avenue, based on the findings of the Minor Variance <br />Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property. <br /> <br />60-day Time Limit: Application accepted on January 12, 1998; Decision deadline is March 13, 1998. <br /> <br />Prepared by: Kim L.
