<br />with site development. Pedestrian access must be provided from this <br />sidewalk to the front door of the building via a paved pedestrian surface. <br /> <br />6. Prior to a building permit being issued for redevelopment of the site, the <br />applicant shall post a landscape bond, letter of credit, or other security <br />acceptable to the City, in an amount equal to 150% of the cost of site <br />landscaping, street tree planting, and site restoration. The specific amount <br />of this security shall be determined by the Community Development Director <br />following completion of all site construction plans. <br /> <br />7. The applicant shall record the approved conditional use permit with the <br />Ramsey County Recorder prior to the issuance of any building permit or <br />within sixty days of approval, whichever is less (Section 1013.01-City Code). <br /> <br />8. The conditional use permit shall expire within six months of the date of City <br />Council approval if a building permit is not obtained for the approved <br />development (Section 1013.03 of the City Code). <br /> <br />9. The applicant and/or underlying property o'v'mer shall grant an access <br />easement along the '"estern edge of the property to the City in order to <br />provide a public access from County Road 8 south to the McDonald's <br />property shall cooperate with the City in efforts to develop an access <br />easement along the western edge of commercial properties in this area from <br />McDonald's north to County Road B (Changed by Planning Commission). <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 On February 11, 1998, the Planning Commission held a public hearing on the <br />request. Craig Barnes, McDonald's Corporation, and Steve Halverson, NIPS, Inc., <br />were present to answer questions and provide additional information. No residents <br />present commented on this request. <br /> <br />5.2 The Planning Commission discussed the proposed access easement along the <br />western portion of the property. Concerns were expressed regarding the need for <br />an easement for McDonald's at this time, since other easements are not in place. <br />Concerns were also expressed regarding the need for an east-west access between <br />the north-south access being discussed and the frontage road. <br /> <br />5.3 The Planning Commission recommended approval of the request for a conditional <br />use permit to allow the construction and operation of a new take-outlself-service <br />restaurant (McDonald's) at 2075 Snelling Avenue North, based on the findings <br />outlined in Section 3.1 of this report and with the 11 conditions outlined in Section <br />4.1 of this report, with condition #9 amended as follows (6-0): <br /> <br />9.
