The redevelopment of the property as proposed is consistent with the City of <br />Roseville's Comprehensive Plan and Title 10 of the City Code (Zoning), including <br />the City's design standards. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City <br />of Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a conditional use <br />permit to allow the construction and operation of a new take-outlself-service restaurant <br />(McDonald's) at 2075 Snelling Avenue, be approved subject to the following conditions: <br /> <br />1. The site must be developed in accordance with the final plans (site plan dated <br />1/12/98), grading and drainage plan (dated 1/12/98), utility plan (dated 1/12/98), <br />planting plan (modified 3/4/98), and building elevations (dated 3/4/98) submitted <br />and approved in conjunction with the request for a conditional use permit. Minor <br />variations from the approved plans may be approved by the City's Development <br />Review Committee, under the direction of the Community Development Director; <br />however, any substantial departures from the approved plans will require an <br />amendment to the conditional use permit. <br /> <br />2. <br /> <br />Final grading and utility plans must be reviewed and approved by the Public Works <br />Director. An erosion control plan must be developed and erosion control must be <br />in place prior to grading of the site. Since the site is less than 2.5 acres in size, it <br />is unlikely that on-site ponding will be required by the Rice Creek Watershed <br />District; however, the applicant will need to contact the District for permit <br />requirements. <br /> <br />3. All site lighting, including lighting for the parking area and exterior building lighting, <br />must comply with the requirements of Section 1010.12 of the City Code. <br /> <br />4. All signage for the project must comply with the requirements of Section 1009 of the <br />City Code, including the size and location of wall, pylon, and directional signs. <br /> <br />5. The sidewalk along the front of the property shall be improved and/or replaced, at <br />the applicant's expense, if required by the City in conjunction with site development. <br />Pedestrian access must be provided from this sidewalk to the front door of the <br />building via a paved pedestrian surface. <br /> <br />6. <br /> <br />Prior to a building permit being issued for redevelopment of the site, the applicant <br />shall post a landscape bond, letter of credit, or other security acceptable to the City, <br />in an amount equal to 150% of the cost of site landscaping, street tree planting, and <br />site restoration. The specific amount of this security shall be determined by the <br />Community Development Director following completion of all site construction plans. <br /> <br />Resolution 9531 - Page 2 of 3 <br />
