A request to divide the lot into two parcels was denied in 1975; however, the <br />official record does not indicated why the request was denied. <br /> <br />6. The proposed variance from the lot area and width requirements is in <br />harmony with the general purpose and intent of the City's Comprehensive <br />Plan and Title 10 of the City Code (Zoning). <br /> <br />7. The proposed variance from the lot area and width requirements, if granted, <br />will not adversely affect the public health, safety, or general welfare. <br /> <br />4.0 STAFF RECOMMENDA TION <br /> <br />4,1 Based on the findings outlined in Section 3.1 of this report, staff recommends that <br />the request be approved with the following provisions: <br /> <br />1. A sanitary sewer utility servicing plan for the existing house must be <br />submitted to and approved by the City Engineer, and the relocation of the <br />service line must be accomplished prior to the lot split being finalized by the <br />City and recorded. <br /> <br />2. Additional right-of-way easements/dedications for County Road 8 (10 feet) <br />and Burke Avenue (15 feet) must be dedicated prior to the lot split being <br />finalized by the City and recorded. <br /> <br />3. The deferred assessment of $1 ,345.09 must be paid prior to recording the <br />lot split. <br /> <br />5.0 SUGGESTED ACTION <br /> <br />5.1 By motion, recommend City Council approval of the request for a variance a lot size <br />variance to reduce the lot area of one parcel to 8,911 square feet, and the lot width <br />of both parcels to 79.56 feet for the purpose of subdividing a parcel of record into <br />two parcels at 964 County Road B W, based on the findings outlined in Section 3.1 <br />of this report and with the provisions outlined in Section 4.1 of this report. <br /> <br />Attachments: location map; notification map; notice of public hearing; certificate of survey (1975); proposed <br />lot split; narrative from Marlene Michels. <br /> <br />60-day Time Limit: application submitted on January 12, 1998; application accepted as complete on January <br />22, 1997; decision deadline is March 13, 1998. <br /> <br />Prepared by: Kim L.
