<br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City <br />of Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that an interim use permit <br />to allow the concrete crushing and mixing operations on a portion of a 20-acre County- <br />owned parcel located east of Kent Street and north of Larpenteur Avenue be approved <br />subject to the following conditions: <br /> <br />1. Only materials from the Larpenteur Avenue reconstruction project may be crushed <br />and batch mixed at this location. No other construction projects shall be allowed to <br />"piggy-back" on this activity. <br /> <br />2. Stockpiles of concrete to be crushed and/or crushed concrete shall not exceed 20 <br />feet in height and shall remain on the site, in the location and with the setbacks <br />illustrated in the approved site plan, for a period not to exceed one year. The site <br />shall be gated and locked when not in operation. <br /> <br />3. Concrete crushing activities shall be limited to a maximum of 15 days between April <br />1 and May 15 in 1998, a maximum of 15 days between January 1 and May 15 in <br />1999, and a maximum of 10 days during the construction season in 2000. Hours <br />of crushing activities shall be limited to 8:00 a.m. to 5:00 p.m., Monday through <br />Friday. <br /> <br />4. Concrete batch mixing activities shall be limited to a maximum of two separate <br />occasions per construction season in 1998, 1999, and 2000, for up to five working <br />days per occasion. Hours of concrete batch mixing and hauling activities shall be <br />limited to 7:00 a.m. to 10:00 p.m., Monday through Friday. <br /> <br />5. Effected residents shall receive written notice from the County at least five days <br />prior to the commencement of concrete crushing or concrete batching activities. <br />The original list of residents to be notified will be provided by the Community <br />Development Director, with the understanding that other residents will be placed on <br />the notification list by requesting such action of the County. <br /> <br />6. The County shall provide the City with a letter from the Minnesota Pollution Control <br />Agency stating that the noise levels of the crushing and batch mixing machinery, <br />carrying belts, loading equipment, and hauling equipment (when all are in operation) <br />do not exceed MPCA noise standards or are exempt from such standards. If such <br />a letter cannot be obtained, or as an alternative to meet noise standards in <br />residential neighborhoods, the County may propose sound baffle wood walls <br />surrounding the equipment as approved by the City's sound consultant. <br /> <br />7. The County shall submit a site plan with accurate dimensions, landscape plan, berm <br />grading and seeding plan, circulation plan, and erosion control plan to the <br />Community Development Director for review and approval prior to issuance of the <br />Interim Use Permit. The landscape plan shall include the installation of a vegetative <br />screen along north berm area of the site. The vegetative screen shall include no <br />fewer than 40 evergreen trees, not less than 6 feet in height planted eight feet on <br />center. All plantings, grading, seeding, and erosion control improvements shall be <br />completed by July 1, 1998. <br /> <br />Resolution _ - Page 2 of 4 <br />
