<br />JRN.11.1999 10:43RM <br /> <br />ROSE/COMM/DEV 4902931 <br /> <br />NO. 484 <br /> <br />P. 3/11 <br /> <br />For three (3) years from the date of this Agreement, no amendments to the CITY'S Comprehen!:iive <br />Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless required <br />by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any <br />improvements proposed therea.fter, notwithstanding anything in this Agreement 10 the contrary, the <br />CITY may require compliance with any amendments to the City's Comprehensive Guide Plan. <br />official controls. pLatting or dedication requirements enacted after the date of this Contract. <br /> <br /> <br />4.0 Approval by the CllY <br /> <br />In approving the final development plan for the PUD for Charles Cabinet. the CITY hereby <br />incoTporates the following exhibits. The DEVELOPER shall develop the subject property as <br />described or shown in these exhibits. If the exhibits vary from the written tenns of this Agreement, <br />the written terms shall control. The exhibits marked as approved by the City Council on January 25, <br />1998, or as amended thereafter, shall include: <br /> <br />a. Certifi~te of Survey of the property lines and all existing sjte ilnprovements <br />dated: <br /> <br />b. Grading and drainage plan illustrating existing grades and those proposed after <br />completion of the proposed constru.Gtion, drainage directions, spot elevations, catch <br />basins for surface water catchment dated: <br /> <br />c. Complete Landscape Plan with materials list, sizes, and locations of all plant. <br />ma.terials dated: <br /> <br />d. Building elevations, first and second floor plans with all dimensions; and, building <br />mateliaJs identitied on the building plans dated: <br /> <br />e. Paving and parking plan illustrating all existing and proposed paved parking spaces. <br />parking curbs. loading areas, sidewalks, and future expansion and/or proof of parking <br />spaces, dated: <br /> <br />f. Development schedule with installa.tion dates of improvements, <br />dated: <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on FebruaJ:Y II, 1998 (planning Commission - sketch <br />plan review), July 8, 1998 (Planning Commission - sketch plan review), September 9, 1998 <br />(Planning Commission - hearing on concept development plan). October 14, 1998 (planning <br />Commission - continued hearing concept development plan), October 26, 1998 (City COWlcil - <br />meeting on concept development plan), January 25, 1999 (City Council - action on fmal <br />development plan) to consider various aspects of the Plarmed Unit Development, including rezoning <br />of the subject propel1y from R-I Single Family Residential to PUD Planned Unit Development.
