<br />3320008 <br /> <br />Except: That part of Lot 4, Block 1, Rochats Addition, described as <br />Commencing at the northwest corner of said Lot 4; thence on an assumed <br />bearing of South 90 degrees 00 minutes 00 seconds East, along the north <br />line of said Lot 4, 50.21 feet to the point of beginning of the parcel to be <br />described; thence continuing South 90 degrees 00 minutes 00 seconds East, <br />30.09 feet; thence South 02 degrees 02 minutes 02 seconds West, 6.42 feet; <br />thence North 87 degrees 57 minutes 58 seconds West, 30.07 feet; thence <br />North 02 degrees 02 minutes 02 seconds East, 5.35 feet to the point of <br />beginning. <br /> <br />PARCEL B: The southern parcel is described as the South 36 feet of Lot 5, the <br />North 9.5 feet ofthe South 45.5 feet of the East 21 feet ofthe West 101 feet of Lot <br />5, and all of Lot 6, Block 1, Rochat's Addition to the City of Roseville, Ramsey <br />County, Minnesota (PID # 042923220011). <br /> <br />3.0 Planned Unit Development and Plat Approval <br /> <br />The CITY hereby grants approval ofthe final development plan for Charles Cabinet Planned Unit <br />Development, subject to the DEVELOPER's compliance with the terms and conditions of this <br />agreement. The CITY agrees to approve applications for building permits, provided that said <br />plans are consistent with the exhibits which were approved at the concept and final stage of the <br />Planned Unit Development process (located in Appendix A), the DEVELOPER has not defaulted, <br />and all of the standards and conditions of this agreement have been satisfied. <br /> <br />For three (3) years from the date of this Agreement, no amendments to the CITY'S Comprehensive <br />Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless <br />required by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any <br />improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, <br />the CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, <br />official controls, platting or dedication requirements enacted after the date of this Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD for Charles Cabinet, the CITY hereby <br />~n~~rporates the following exhibits. The DEVELOPER shall develop the subject property as <br />described or shown in these exhibits. If the exhibits vary from the written terms of this <br />Agreement, the written terms shall control. In the event the exhibits address items not specifically <br />addressed in this agreement, the exhibits shall govern with respect to those items.
