the purpose of constructing, repairing, replacing and/or maintaining the storm sewer line to be located within the Easement Area, All costs of constructing, repairing, replacing and/or maintaining the storm sewer line within the Easement Area shall be borne by the owner of Parcel 2. Any damage caused to the Easement Area, or other portion of Parcel l, as a result of the construction, repair, replacement and/or maintenance of the 5tonn sewer line, shall be repaired by the owner of Parcel 2, at its sole expense, to the condition that existed immediately prior to such damage. The owner of Parcel 2 shall indemnifY, defend and hold harmless the owner of Parcel 1 from any and all losses, claims and damages arising out of the construction, repair, replacement and/or maintenance of the stann sewer line, including but not limited to, claims for injury, death, property damage and mechanic's liens. 3. No Obstructions. The owner of Parcel 1 shaII not locate or construct any buildings, dwellings or other structures within the Easement Area, 4.
