<br />6.0 Development of Property <br /> <br />6.1 Failure by the DEVELOPER to complete an overall planned unit development <br />(Phase II) by April 1, 1999, will necessitate the approval of an extension of the <br />development schedule by the City Council prior to the expiration of the one year <br />period. If an extension is not applied for and received by April 1, 1999, the Council <br />may instruct the Planning Commission to initiate default proceedings and rezoning <br />of the entire property to the original B-2 zoning district. <br /> <br />6.2 The overall planned unit development for Phase II shall, at a minimum, address the <br />following: <br /> <br />A. Reconfiguration and improvement of off-street parking areas; <br />B. Upgrading of the signage for the shopping center; <br />C. RedevelopmenUimprovement of the two pad sites currently occupied <br />by MotoPhoto and Dairy Queen; and <br />D. Screening of off-street loading areas and trash collection areas along <br />the rear side of the buildings from the adjacent residential uses. <br /> <br />7.0 Compliance with Laws and Regulations <br /> <br />The DEVELOPER represents to the CITY that any site improvements pursuant to the <br />proposed Development will comply with all City, County, Regional, Metropolitan, State, and <br />Federal laws and regulations, including but not limited to the Roseville Subdivision <br />Regulations, the Roseville Zoning Regulations, and all other applicable environmental <br />regulations. The DEVELOPER agrees to comply with aU such laws and regulations. <br /> <br />8.0 PUD Standards/Conditions of Approval <br /> <br />To insure that the proposed development meets the CITY'S standards for the approval of <br />a PUD, as set forth in Section 1015 of the Roseville City Code, the Development shall also <br />comply with the following specific PUD standards: <br /> <br />8.1 The use of property within the PUD shall be limited to the existing two-building <br />96,000 square foot (approximate) multi-tenant retail facility and two free-standing <br />buildings on pad sites (MotoPhoto and Dairy Queen), and shall be restricted to the <br />uses currently allowed in the underlying B-2 zoning district, as well as dry cleaning <br />service facilities (processing). <br /> <br />8.2 For dry cleaing service facilities (processing), an impervious floor and approved <br />exhaust venting shall be installed in any space occupied by a dry cleaning <br />businesses with on-site processing prior to issuance of a certificate of occupancy. <br /> <br />8.3 Where not superseded by more restrictive requirements of this PUD, the standards <br />of the underlying B-2 zoning district shall apply, as stated in Chapter 1005 of the <br />Roseville City Code. <br /> <br />PUD Phase I Agreement #_ {Lexington Plaza} - Page 2 of 4 <br />
